Business Disparagement

In Nevada, the elements for a claim of business disparagement are:

1.         A false and disparaging statement that interferes with the plaintiff’s business or are aimed at the business’s goods or services;

2.         The statement is not privileged;

3.         The statement is made with malice; and

4.         Proof of special damages.
